Buyer Terms of Service
These Terms set out the conditions under which Buyers use the platform “Japan Retro Camera Wholesale” operated by His50s LLC. The Company provides a venue where Sellers and Buyers transact directly and is not a party to any sale.

Article 1 Purpose
These Terms of Service (the “Terms”) set forth the conditions under which Buyers use the platform “Japan Retro Camera Wholesale” (the “Service”) provided by His50s LLC (Godo Kaisha His Fifties) (the “Company”).
Article 2 Definitions
- “Buyer” means a business entity (such as a camera shop or wholesaler) that submits Quote Requests for, or purchases, products listed by Sellers through the Service.
- “Seller” means a person who lists and sells cameras and related products under its own name on the Service.
- “Quote Transaction” means a direct sales contract concluded between a Seller and a Buyer through the Service.
Article 3 Registration Requirements
A person who wishes to register as a Buyer must satisfy the following requirements:
- Be a business entity engaged in the commercial procurement of cameras and related products (individual collectors are not eligible);
- Accurately register its corporate name, representative’s name, country of location, and contact email address;
- Hold, as necessary, any statutory permits or registrations required in its country for the parallel import and sale of cameras and related products;
- Not be an anti-social force or a related party thereof; and
- Agree to these Terms.
Article 4 Fees
Use of the Service by Buyers is free of charge.
Article 5 Role of the Company; Non-Intermediation Model
- The Company only provides “a venue where Sellers and Buyers negotiate and transact” through the Service, and is not a party to any transaction.
- The Buyer acknowledges that any sales contract concluded through the Service is entered into directly with the Seller.
- The Company is not involved in payment, remittance, or receipt of funds between Sellers and Buyers. Settlement shall be made directly by the means of payment (such as a Wise remittance link) presented by the Seller.
- The Company does not provide escrow and does not, even temporarily, receive, hold, keep, or manage any purchase price or other funds between Sellers and Buyers. Payment always flows directly from the Buyer to the Seller and never passes through any bank account, payment account, or wallet held by the Company. The Company does not engage in any funds-transfer (exchange transaction) business under the Payment Services Act of Japan.
- In the event of a dispute, the Company may, at its discretion, intervene manually with the other party, but shall have no obligation to arbitrate.
Article 6 Transaction Flow
- The Buyer may add “multiple products from the same Seller” to its cart on the Service and submit a Quote Request with a minimum of three (3) items.
- The Buyer shall accept or reject the Quote presented by the Seller within the validity period (seven (7) days). If the Buyer does not respond within the period, the Quote shall automatically expire.
- A sales contract shall be concluded with the Seller upon acceptance of the Quote.
- After the contract is concluded, the Buyer shall promptly make payment by the means of payment presented by the Seller.
- After receiving the products, the Buyer shall record receipt confirmation on the Service.
Article 6-2 Customs Duties and Import Taxes / DDU
- Shipment of products through the Service shall, in principle, be made under DDU (Delivered Duty Unpaid) terms.
- The Buyer shall bear, at its own expense, customs duties, import consumption tax, VAT/GST, customs clearance fees, and other public charges and taxes relating to importation in the destination country (the country in which the Buyer is located).
- The quoted amounts and invoiced amounts presented by the Seller do not include the foregoing customs duties and taxes. These shall be paid directly by the Buyer upon arrival of the products or in accordance with the instructions of the customs authority of the relevant country.
- Payment of customs duties and taxes and customs clearance procedures shall be subject to the laws and regulations of each country and the discretion of each country’s customs authority. Neither the Company nor the Seller guarantees the customs determination, amount of customs duties, or time required for customs clearance in the destination country.
- If the Buyer refuses to receive the products due to non-payment of customs duties or the like, or if the products are detained or destroyed in customs clearance, the resulting losses (shipping fees, customs duties, disposal costs, etc.) shall be borne by the Buyer.
Article 7 Returns
- If a product has a defect, the Buyer shall first submit a return request to the Seller through the chat function of the Service.
- Refunds shall be made either (i) by a cash refund remitted directly from the Seller to the Buyer (e.g., via Wise), or (ii) as a discount coupon issued by the Seller (a discount applicable to a future purchase from the same Seller; this is not a deposit of money or a monetary balance).
- The Company does not hold any funds relating to returns or refunds and does not guarantee the Buyer’s receipt of a refund. With respect to the discount coupon set forth above, the Company merely records its issuance and use, and does not receive, hold, or manage any monetary balance.
Article 8 Prohibited Acts
The Buyer shall not engage in any of the following:
- Soliciting the Seller to transact outside the Service; provided, however, that email, telephone, or other communications made in performance of a concluded contract shall not be deemed prohibited;
- Continuing negotiations regarding Quotes or transaction terms outside the chat function of the Service;
- Accepting a Quote without the intention to pay;
- Repeatedly making unjustified return requests after receiving products;
- Acts that damage the reputation or interfere with the business of the Company or other users; or
- Selling or exporting, in violation of the laws of the Buyer’s country, cameras obtained through the Service.
Article 9 Disclaimer
- The Company shall not be liable for any disadvantage suffered by the Buyer due to suspension, interruption, or loss of data of the Service, except in the case of willful misconduct or gross negligence on the part of the Company.
- The Company does not guarantee the accuracy of any Seller’s listings, the quality or authenticity of any products, or the performance of any transaction.
- The Company shall bear no responsibility whatsoever for any contracts, transactions, or disputes between Sellers and Buyers.
Article 10 Suspension; Removal of Registration
The Company may suspend or remove a Buyer’s registration without prior notice in the following cases:
- Where the Buyer has violated these Terms;
- Where the registered information contains falsehoods; or
- Where serious disputes from Sellers have recurred.
Article 11 Withdrawal
The Buyer may withdraw from the Service at any time. If transactions are in progress at the time of withdrawal, the Buyer shall have an obligation to complete them in good faith.
Article 12 Changes to the Terms
- The Company may change these Terms at its discretion.
- Changes shall take effect upon the expiration of thirty (30) days following notice given by email or on the Service.
Article 13 Governing Law; Jurisdiction
- These Terms shall be governed by the laws of Japan.
- In the event of a dispute arising in connection with these Terms, the Chichibu Branch of the Saitama District Court shall be the exclusive agreed court of first instance.
